Client (referred to as “You”, “Your”) means any person or entity engaging Miracle Dreambaby Sleep Consulting for their services as discussed in these Terms of Service.

By using this website or purchasing a service you are agreeing to Miracle Dreambaby Sleep Consulting terms and conditions.

Your access to and use of Our services is conditioned on Your acceptance of and compliance with these Terms and Conditions. By accessing, using or purchasing Our Services You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Services.

Your access to and use of Our Services is also conditioned on Your acceptance of and compliance with Our Privacy Policy. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information and when You use Our Website. Please read Our Privacy Policy carefully before using Our Service.

Package support

At Miracle Dreambaby Sleep Consulting, Our sole purpose of practice is to provide You with support and education in relation to Your Child(s) sleep. We do not intend to replace medical advice.

If You are concerned about a potential medical or nutritional issue related to Your Child(ren) You agree to check and obtain clearance with Your trusted health professionals or Paediatrician immediately before purchasing a package or at the advice of Miracle Dreambaby Sleep Consulting. We reserve the right to refuse a service if we are concerned for your child/ren’s current health and welfare.

By using Our services, You agree to follow all guidelines relating to safe sleep practices. These guidelines can be found at Red Nose.org- safe sleeping and American Academy of Pediatrics’ (AAP) Read the AAP’s full guidelines for parents on their site, “ How to Keep Your Sleeping Baby Safe: AAP Policy Explained”

For Us to provide You with the best advice and support, You agree that you will only provide Us with accurate information when communicating with Us and will not provide misleading, false, or inaccurate information.

You agree that in order to achieve realistic results and expectations You need to commit, follow, and implement all the changes recommended within the sleep plan and throughout the support period allocated to Your package. You agree that it is Your responsibility to implement these suggested changes and Miracle Dreambaby Sleep Consulting can only provide You with the support and guidance to achieve this.

Miracle Dreambaby Sleep Consulting will not be liable for anything practiced outside of the suggestions/instructions provided within Your sleep plan or other communications. Miracle Dreambaby Sleep Consulting takes no responsibility for the final outcome as results depend heavily on Your commitment, patience, consistency, and time You allow to implement changes in order to make adjustments.

You understand that Your Child’s(ren’s) sleep plan(s) and assessment(s) are specifically tailored for Your individual circumstances and therefore it should not be shared with a third party for use. There is no professional relationship formed between You and Miracle Dreambaby Sleep Consulting unless you explicitly choose to work with me by purchasing one Our services.

Purchases

By purchasing a package through the website, You warrant that You are legally capable of entering into binding contracts.

If You wish to place an order for a package available on the website, You may be asked to supply certain personal information relevant to Your order. By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your purchase.

Payment is required at the time of an online purchase or 24 hours after receiving an invoice unless other arrangements have been made.

Miracle Dreambaby Sleep Consulting reserves the right to alter prices at any time for any reason.

A sleep plan will not be issued or a consultation will not take place with outstanding invoices remaining. Miracle Dreambaby Sleep Consulting reserves the right to cancel a consultation if there is an outstanding balance owing at the time of the scheduled consultation

Package Cancellation and/or refund

At Miracle Dreambaby Sleep Consulting We understand that life can sometimes bring Us challenges out of our control. If You require a refund or need to put the package on hold for any reason, We will do our best to work with You and come to a resolution at the discretion of Miracle Dreambaby Sleep Consulting.

When you decide to purchase a package containing a follow-up support period, you must access this within 7 days of receiving your plan for it to remain valid. Failure to do so will result in the expiration of the follow-up support and a repurchase will be necessary.

If You need to reschedule a consultation for any reason. A minimum of 24 hours’ notice must be provided to Us in email writing.

If You have to cancel a consultation within 48 hours of the booking, We will only refund you 50% of the amount of any payment made.

A full refund will be provided for cancellations with more than 48 hours’ notice in email writing.

You will not be eligible for a refund if You choose to cancel or exit a package before the completion date. This includes after an initial consultation, after a sleep plan has been provided or during the support period.

We reserve the right to refuse or cancel Your package at any time for certain reasons including but not limited to:

• Package availability: In this case We will provide you with an option of alternative dates. We understand that these may not suit Your circumstances, so You reserve the right to request a refund.
• Errors in Your purchase: If Your location is outside our service area and an alternative package needs to be arranged
• Errors in the description or prices of packages
• Concerns about the health and welfare of Your child/ren We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected. In the unlikely event that You have any complaints about Our packages or services please get in contact as soon as possible so that We can work together to find a resolution.

Conditions of a Sleep Plan

You agree and understand that You have 7 days to start implementing the customized sleep plan after receiving the customized sleep plan or You will have to purchase a new package or follow-up support as the information will no longer apply to Your child(ren). You understand that the customized sleep plan is personalized for Your child(ren) and should not be shared with a third party.

You acknowledge that any changes You make to Your child’s(ren’s) customized sleep plan is Your choice and may result in unsuccessful outcomes. It is Your responsibility to contact Miracle Dreambaby – Sleep Consultant for Your follow-up and send the sleep log information through to her to be assessed for feedback as frequently as she suggests. You understand that accepting Miracle Dreambaby – Sleep Consultant’s customized sleep plan and services does not guarantee positive results for Your child(ren). You agree that the entire process takes patience, consistency and commitment for positive results.

In-Home Support

During the in-home consultation, You will make a plan with Miracle Dreambaby Sleep Consultant when the in-home support will take place.

The Client is responsible for informing Miracle Dreambaby Sleep Consultant who will be in the home during the in-home support and their relationship to the Client. If Miracle Dreambaby Sleep Consultant arrives at the home and does not feel it is appropriate or safe to enter the home, the in-home consultation will be rescheduled if Miracle Dreambaby Sleep Consultant deems it safe to do so.

If at any time during the in-home consultation, Miracle Dreambaby Sleep Consultant doesn’t feel it is appropriate to stay due to safety concerns; the in-home consultation will be concluded and rescheduling of the remaining in-home consultation will not be provided. Refunds are not available for in-home consultation packages.

General

Miracle Dreambaby Sleep Consultant is constantly updating Our website and packages. We do Our best to ensure all information regarding Our packages is correct however due to circumstances out of Our control, We may experience delays in updating information regarding Our packages and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including but not limited to prices, product images, availability, and services. We reserve the right to change, update or revise information and to correct errors, inaccuracies, or omissions at any time without prior notice. Packages already purchased will not be affected.

Miracle Dreambaby Sleep Consultant maintains this site for your personal information, education and communication. Please feel free to browse the site. The Client and any visitor to this website may download material displayed on the website for personal, non-commercial use, provided the Client also retains all copyright and other proprietary notices contained on the materials. You may not for any reason, however, distribute, modify, duplicate, transmit, reuse, repost, or use the content of the site for public or commercial purposes, including the text, images, audio, and video without Miracle Dreambaby Sleep Consultant’s written permission.

Miracle Dreambaby Sleep Consultant owns all copyright in and to the content on this website and the materials, texts, advice, guidance, manuals, and technical information provided to you. The Client may download content only for their personal use for non-commercial purposes, but no modification or further reproduction of the content is permitted. The content may otherwise not be copied or used in any way without express written permission of Miracle Dreambaby Sleep Consultant or the author of any particular submission.

All care is taken in the preparation of the information and published materials including in the Services, the Products, in the associated blog, on the Website or on any other related platform. Miracle Dreambaby Sleep Consultant does not make any representations or give any warranties about its accuracy, reliability, completeness or suitability for any particular purpose.

To the extent permissible by law, Miracle Dreambaby Sleep Consultant will not be liable for any expenses, losses, damages (including indirect or consequential damages) or costs which might be incurred as a result of the information being inaccurate or incomplete in any way and for any reason or your reliance on the information, advice or documentation in the Services, the Products, associated blog, on the Website or on any other related platform.

The laws of Australia, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Confidentiality and Privacy Policy

You acknowledge that Miracle Dreambaby Sleep Consultant will uphold Your case in confidentiality and discretion.

You confirm that You will not share Your child’s sleep plan or its content with any third party without Miralce Dreambaby Sleep Consultant’s permission to do so. By sharing the plan, it may not be in the third party’s best interest for the child as these plans are customized to each child’s needs.

Information we collect

Miracle Dreambaby Sleep Consultant will collect typical personal information including name, address, phone number, and email address. Miracle Dreambaby Sleep Consultant will use Your personal information to create an online registration for You, to record and process your package for general communication.
